B.C. Court Grants Delay in Gitanyow Title Case, Citing Appeals by Nisga’a & Tsetsaut/Skiik’m Lax Ha
The B.C. Supreme Court granted an adjournment of the Gitanyow’s Title case pending the outcome of appeals of Chief Darlene Simpson (Skiik’m Lax Ha) of the “Tsetsaut/Skiik’m Lax Ha” and the Nisga’a Lisims Government. The request for a ‘stay’ or a complete halt of the title case was dismissed.

With substantial changes to the Prince Rupert Gas Transmission pipeline project since the environmental assessment certificate was issued over a decade ago, a better understanding of cumulative effects and the Declaration on the Rights of Indigenous Peoples Act enacted, the significant concerns raised by the Gitanyow Hereditary Chiefs need to be answered by the B.C. government before a “substantial start” decision is made.
